On 25 May 2016, the European Chemical Agency (ECHA) published a guideline on the scope of lead restriction in consumer products under entry 63 (paragraphs 7 to 10) of Annex XVII to REACH.
The purpose of this guideline is to ensure a common understanding of the scope and effective implementation of the lead restriction in consumer products. It clarified certain terms that defined the scope of the restriction (e.g. "accessible part of articles", "normal/reasonably foreseeable conditions of use"). It also provided non-exhaustive lists of article types (and examples of sub-types) which fall within or out of the scope of the restriction.
On 23 April 2015, REACH restriction on lead in consumer products was published as Regulation (EU) 2015/628, and amended the lead restriction in Entry 63 of REACH Annex XVII. From 1 June 2016, all the articles which fall within the scope of this restriction and do not comply with the requirements of this restriction, should not be placed on the European Union (EU) market.
At the meanwhile, following the request of the European Commission (EC), ECHA prepared a draft guideline to support regulators and stakeholders in the implementation of the restriction, and launched a call for comments on the draft guideline in April 2015. According to the received comments, ECHA revised the draft guideline and published the final guideline on 25 May 2016.
