On 22 September 2016, Italy notified1 the European Commission (“EC”) through the Technical Regulations Information System (“TRIS”) on a draft Regulation amending the Health Ministry Decree of 21 March 1973 (“DM 21 March 1973”) on the Hygiene rules for packaging, containers and utensils intended to come into contact with foodstuffs or personal-use products. The amendment only concerns the section on surface coating. The final date for EC and other EU Member States to comment on the draft is 23 December 2016 and the proposed date of adoption as law is not specified in the notification.
The proposed amendment adds 1 substance to the List of authorized substances for the preparation of articles intended for contact with food in Part A ‘Resins’ of Section I ‘Plastic Materials’ of Annex II to the DM 21 March 1973. The new substance can be used as a cross-linking monomer for the production of polymer surface coatings for metal materials and objects intended to come into contact with foodstuffs (e.g. internal coating of metal cans for beverages and foodstuffs). Table 1 shows the details on the proposed new substance.
