On 22 September 2016, Italy notified1 the European Commission (“EC”) through the Technical Regulations Information System (“TRIS”) on a draft Regulation amending the Health Ministry Decree of 21 March 1973 (“DM 21 March 1973”) on the Hygiene rules for packaging, containers and utensils intended to come into contact with foodstuffs or personal-use products. The proposed amendment only concerns the section on stainless steel. The final date for EC and other EU Member States to comment on the draft is 23 December 2016 and the proposed date of adoption as law is not specified in the notification.
The proposed amendment makes the following changes to Part A and Part B of Section VI of Annex II to the Ministerial Decree of 21 March 1973 related to stainless steel.
Inserted 7 steels that may be used in contact with foodstuff in Part A of Section VI of Annex II. Table 1 shows the details of the newly added steels.
Makes clear the test conditions for specific authorised stainless steel, and
Amends the table in Part B of the Annex on stainless steel identified by chemical analysis of the casting, without codes provided for under European or international law pursuant to part A. It also makes clear the test conditions.
